NO PURCHASE IS NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.  A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

1. Eligibility: This “#PLAYBACKREMOTE” Video Contest (the “Contest”) is open to any person aged 18 or older at the time of entry ("the Entrants"). The Contest is only open to legal residents of the lower 48 contiguous United States and the District of Columbia, excluding Florida, New York and Rhode Island and is void where prohibited by law.  Unless specifically otherwise allowed in these Contest Official Rules, the following are ineligible to participate in the Sweepstakes:

• Employees of MultiTracks.com, LLC and its affiliates, subsidiaries, prize providers advertising, promotion, fulfillment or other coordinating agencies, individuals providing services to MultiTracks.com, LLC through an outsourcer or temporary employment agency during the Contest Period, and their respective immediate family members and/or persons living in their same household;
• Non-natural persons (including corporations and other business entities); and
• Any person located in a “Restricted Country”. Restricted Countries are: Côte d’Ivoire, Cuba, Democratic Republic of the Congo, Iran, Libya, Republic of the Congo, Somalia, Myanmar, North Korea, Sudan and Syria.

2. Agreement to Rules: By participating, the entrant (“You”) agrees to be fully unconditionally bound by these Official Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of MultiTracks.com as final and binding as it relates to the content of this Sweepstakes. 

3. Contest Period: The Contest begins at approximately 2:00 p.m. CST on December 12, 2023, and runs through 11:59 pm CST January 31, 2024 (the “Contest Period”). Submissions will be accepted only during the Contest Period.  MultiTracks.com is the official timekeeper for the Sweepstakes.  MultiTracks.com reserves the right to modify or cancel this promotion at any time.

4. How to Enter:  

Participation Requirements:  To participate, eligible Entrants must have an Instagram account to enter. If a prospective entrant does not have an Instagram account, the entrant can create one at no cost at www.instagram.com. Entrants must agree to comply with Instagram terms of service and privacy policy to create an account. Only the entrant who does the tagging will be entered to win. Tagged friends will not be entered to win.   MultiTracks.com may not receive Submissions from Instagram users with “private” updates (i.e., if Entrant has set his or her account so that only people the Entrant has approved can view his or her updates). If Entrant is using Entrant’s mobile device to enter, charges, including message and data rates, may apply. Entrants should consult their wireless service provider regarding its pricing plans.

Take the following actions during the Contest Period to receive one (1) Contest entry:

• Create your Contest Video: Create a video that is no longer than 1 minute that explains and displays what you love about Playback Remote. You may display or include references to MultiTracks.com products; however, there is no requirement that you do so. It is required that your contest video must be based on your honest opinion and personal experience and otherwise in accordance with the Content Restrictions listed below.  
• You may include music in your Contest Video so long as it is your original creation, or where the music is created by another, provided that your use of the music does not infringe on the creator’s copyright.
• Post your Contest Video on Instagram (as a Story or Reel):
  • Follow @multitracks on Instagram;
  • Post your Contest Video and include the hashtags #PLAYBACKREMOTE #MultiTracks and #Contest within the original caption of your Instagram post; and
  • Your Instagram account settings must remain public, and you must not change your Instagram handle once you have posted your Contest Entry through the time when prize is awarded (as described in Section 7 below); and
    • Note:  Instagram stories and Instagram posts where the hashtag is included in a comment rather than the caption of the original post will not be deemed entries. 
  • By posting your Contest Video on Instagram (herein your "Submission"), you agree that it conforms to the above requirements, permissions, and content restrictions stated below. Sponsor, in its sole discretion, may disqualify your Submission if it believes that it fails to conform. Where your Submission meets all requirements, your Submission will be deemed one (1) Contest entry. 

Permissions: Entrant must have permission from any recognizable individuals who appear in the Submission to use their names and likenesses in the Submission and to grant the rights set forth herein. Minors may only be included in the Submission if entrant is their parent or legal guardian. If requested, entrant must be able to provide such permissions or proof in a form acceptable to Sponsor.

Content Restrictions:

• The Submission must be in English and be your original work;
• The Submission must not convey any claims of Sponsor's products or services that would be deemed unsubstantiated or deceptive if made by Sponsor;
• The Submission must be based on your honest opinion and personal experience;
• The Submission must not contain material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement therefore the Submission must not contain brand names or trademarks other than those owned by Sponsor; and  the Submission must not contain content created by a third party, such as music, images or artwork (unless you have a license to use it);
• The Submission must not disparage Sponsor, or any other person or party;
• The Submission must not promote or reference alcohol, illegal drugs, tobacco, or firearms/weapons, any activities that are or appear to be dangerous, or any political agenda;
• The Submission must not contain material that is inappropriate, offensive, indecent, obscene, sexually explicit, tortious, defamatory, slanderous or libelous;
• The Submission must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age; and
• The Submission must not contain material that is unlawful, in violation of, or contrary to the laws or regulations in any state where Submission is created.

5. Limit: Each entrant may upload one (1) Submission during Contest Period.  Submissions received from any person in excess of the stated limit will be void. Submissions generated by script, macro or other automated means are void. Multiple entrants are not permitted to share the same Instagram account. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different Instagram accounts, identities, or any other methods will void that entrant's entries and that entrant may be disqualified.  In the event of a dispute as to any registration, the authorized account holder of the Instagram account used will be deemed to be the entrant. The potential winner may be required to show proof of being the/an authorized account holder.

6. Sponsor's Use of Submissions: Posting a Submission constitutes entrant's consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for promotional or marketing purposes. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Submission. 

7. Prize:  ONE (1) GRAND PRIZE.  The winner of the Contest (the “Winner”) will receive only the prize listed below.  The Approximate Retail Value (“APR”) actual/appraised value(s) for the Grand Prize may differ at time of prize award. The specifics of the prize shall be solely determined by MultiTracks.com.

   No cash or other prize substitution shall be permitted except at MultiTracks.com discretion. The prize is nontransferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the relevant Winner of the particular prize concerned. No substitution of prize(s) or transfer/assignment of prize(s) to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for MultiTracks.com and its Contest promotional partners and prize providers to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation unless prohibited by law.

8. Winner Selection and Notification: Winner Determination: After the conclusion of the Contest Period, a panel of qualified judges determined by Sponsor in its sole discretion will select the one (1) Submission that receives the highest score from among all eligible Submissions based on the following criteria ("Judging Criteria"):

• Creativity of Submission (33%); 
• Demonstrates passion for worship music using Playback Remote (34%); and
• Quality of Submission (33%)

In the event of a tie, the entrant whose Submission received the highest score for "Demonstrating Playback Remote," as determined by the qualified judges, in their sole discretion, will be deemed the applicable potential winner from among the tied entrants. Sponsor reserves the right to not select a winner, if, in its sole discretion, it does not receive any eligible and qualified Submissions.  Sponsor will not disclose judging scores.

The potential Winner of the Contest will be notified via Instagram direct message (“DM”) from @multitracks within ten (10) days following selection of the Winner for the applicable prize date.  The potential the Contest may be asked for an eligible email address by DM and will then be notified by email and may be required to execute and return an Affidavit of Eligibility/Release of Liability/Publicity (where legal) form within seven (7) days of date of attempted notification.  MultiTracks.com, its promotional partners and prize providers shall have no liability for any Winner’s failure to receive notices due to spam, junk email, or other security settings or for any Winner’s provision of incorrect or otherwise non-functioning contact information. If a Winner cannot be contacted, is ineligible, fails to claim the prize within ten (10) days from the time award notification was sent to such potential Winner, or fails to timely return a completed and executed declaration and release as required, the applicable prize may be forfeited and an alternate Winner for such prize(s) selected from remaining valid, eligible Submissions timely submitted. Allow 6 to 8 weeks for delivery of applicable prize(s).  If a potential winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole discretion. Only three (3) alternate winners may be determined, after which the prize will remain un-awarded.

Receipt by Winner of the applicable prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT MULTITRACKS.COM’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES, AND ALL PRIVILEGES AS A WINNER WILL BE IMMEDIATELY TERMINATED.

• Additional Terms & Conditions:  
  • Any Contest entries (including any content therein) that are submitted, transmitted or otherwise made available to MultiTracks.com (via its Instagram account, its website or otherwise) shall remain the sole and full responsibility of entrant.
  • Accordingly, entrant represents and warrants to MultiTracks.com, its promotional partners and prize providers that any entry submitted in connection with the Sweepstakes: (i) is true, accurate, current, complete and not misleading, fraudulent or deceptive; (ii) will not subject MultiTracks.com, its promotional partners and prize providers to any form of liability or prejudice whatsoever; (iii) is not obscene, offensive, defamatory, and does not contain vulgar or profane language, as determined by MultiTracks.com; (iv) does not and will not violate the rights of any third party, including, without limitation, copyrights, trademark rights, patent, trade secret and/or any other intellectual property rights and any rights of publicity or rights of privacy; and (v) does not and will not violate any applicable state, federal or local laws (including regulations pertaining to sedition, obscenity or abuse).
  • Submissions generated by script, macro or other automated means are void, as are Submissions that are illegible, garbled, incomplete or that contain errors. Normal time, toll, connection and usage rates, if any, charged by your Internet service provider will apply. Additionally, no mechanically reproduced mail-in entries are allowed and any use of robotic, automatic, programmed or the like entry methods will void all such entries by such methods. MultiTracks.com is not responsible for (i) late, lost, illegible, misdirected, damaged, incomplete, improperly submitted, undeliverable or otherwise irregular Contest entries; (ii) theft, destruction, unauthorized access to or alterations of entry materials; (iii) phone, electrical, network, computer, hardware, software program or transmission malfunctions, failures or difficulties.; or (iv) misdirected Submissions or failure to receive Submissions due to limitation of third-party social network platforms; all of which will be void.  All entries become the property of MultiTracks.com.  
  • Submission of an entry constitutes each entrant’s certification that the entry is entrant’s own original work. By submitting any entry, entrant hereby grants MultiTracks.com, its promotional partners and prize providers and their respective successors and assigns a perpetual, irrevocable, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers) and transferable license to use, copy, transmit or otherwise distribute, perform, modify, create derivative works based upon, incorporate into other works, publicly perform and display the entry or any portion thereof, in or through any medium, whether now known or hereafter created in any manner without further compensation during or after the Contest Period. Nothing herein shall constitute an employment, joint venture, or partnership relationship between entrant and MultiTracks.com.
  • In the event of any dispute, an online Contest entry is deemed submitted by the registered Instagram account holder or internet or e-mail account holder associated with the applicable entry. In all other cases, the Contest entry is deemed submitted by the name indicated thereon. Satisfactory proof of association shall be furnished to MultiTracks.com without fail.
  • Except where prohibited, by participating in the Contest and/or winning any prize, entrant consents to the use of his/her name, photo and/or likeness, biographical information, entry and statements attributed to entrant (if true) for advertising and promotional purposes, including without limitation, inclusion in MultiTracks.com newsletters, promotional emails and/or MultiTracks.com web domain at http://www.multitracks.com/, without additional compensation. 
  • All entries become property of MultiTracks.com and none will be acknowledged or returned.
  • No cash or other substitution of prizes is permitted, except at the sole option of MultiTracks.com for a prize of equal or greater value. MultiTracks.com will not replace any lost or stolen prizes. Winners are solely responsible for any and all federal, state, provincial and local taxes, if any, that apply to prizes. If a prize is mailed, the winner assumes the risk of the prize’s safe arrival. Prizes are offered “as is” with no written, express, or implied warranty.

9. Privacy Policy. MultiTracks.com may collect personal data about entrants online, in accordance with its Privacy Policy and as may be more specifically set forth in these Conest Official Rules. Please review these Contest Official Rules and the MultiTracks.com Privacy Policy. By participating in the Sweepstakes, entrants hereby agree to MultiTracks.com collection and use of their personal information and acknowledge that they have read and accepted these Contest Official Rules and the MultiTracks.com Privacy Policy.

10. Third Party Website(s): Where a Contest involves access to or use of a third-party website (“Third-Party Website”), entrant understands and agrees that: (i) MultiTracks.com has no control over the Third-Party Website whatsoever; (ii) Entrant is solely and fully responsible for his dealings with the Third-Party Website and is alone responsible for making whatever investigation entrant feels is needed or useful before commencement of dealings, and taking all precautions deemed necessary to protect himself or herself from viruses, worms, Trojan horses, malware and other harmful or destructive materials potentially residing on the Third-Party Website; and (iii) MultiTracks.com disclaims all responsibility for any harm resulting from entrant’s access to or use of a Third Party Website.  MultiTracks.com assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of entries, or any problem or technical malfunctions of any telephone network or line, computer online systems, servers, or providers, computer equipment, software, failure of any online Contest entry to be received on account of technical problems or traffic congestion on the Internet or at any website (including a Third-Party Website), or any combination thereof, which may limit an entrant’s ability to participate in the Sweepstakes.

11. ANY ATTEMPT BY AN ENTRANT OR ANY THIRD PARTY TO CIRCUMVENT, TAMPER, DISRUPT OR DAMAGE THE CONTEST ENTRY PROCESS, MULTITRACKS.COM WEBSITE, TELEPHONE OR COMMUNICATION SYSTEMS, DEFRAUD OR GAIN AN UNFAIR ADVANTAGE, ENGAGE IN UNSPORTSMANLIKE, DISRUPTIVE, ANNOYING, HARASSING OR THREATENING CONDUCT, OR OTHERWISE UNDERMINE THE FAIRNESS, INTEGRITY AND LEGITIMATE OPERATION OF THE SWEEPSTAKES, WILL RESULT IN AUTOMATIC DISQUALIFICATION FROM THE CONTEST AND MAY CONSTITUTE A VIOLATION OF CRIMINAL AND CIVIL LAWS. MULTITRACKS.COM RESERVES ALL RIGHTS, INCLUDING THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES), TO THE FULLEST EXTENT OF THE LAW, INCLUDING THE POSSIBILITY OF CRIMINAL PROSECUTION.

By participating in this Sweepstakes, Entrant agrees to release, discharge, indemnify, defend and hold harmless MultiTracks.com, its affiliates, subsidiaries, its business partners, prize providers, and promotion and advertising agencies, and directors, officers, employees and agents of any and all of the aforesaid, any other organizations related to the Sweepstakes, and Instagram.com, Inc. from and against any claim, damages or liability due to any injuries, losses or damages to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from receipt, enjoyment, ownership, possession, use, misuse or inability to use any prize, or participation in the Contest or a related activity, whether under contract, tort (including negligence), warranty or any other applicable sources of law, including, without limitation (i) any condition caused by events beyond MultiTracks.com’s control that may cause the Contest to be disrupted or corrupted; (ii) any injuries, losses, or damages (compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Sweepstakes; and (iii) any printing or typographical errors in any materials associated with the Sweepstakes.

IN NO EVENT WILL MULTITRACKS.COM BE LIABLE TO ENTRANT OR YOU FOR ANY DIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF USE, DATA, BUSINESS OR PROFITS) ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE SWEEPSTAKES, WHETHER SUCH LIABILITY ARISES FROM ANY CLAIM BASED UPON CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, AND WHETHER OR NOT MULTITRACKS.COMS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

14. MultiTracks.com assumes no responsibility for any administrative or typographical errors in the course of operating the Contest or in the Contest Official Rules. MultiTracks.com reserves the right, in its sole discretion, to cancel, modify or suspend the Contest in whole or in part, in the event of fraud, technical or other difficulties or if the integrity of the Contest is compromised, without liability to the entrant. MultiTracks.com reserves the right to disqualify any entrant or winner, as determined by MultiTracks.com, in its sole discretion. The Contest is subject to these Contest Official Rules and all applicable federal, state, provincial and local laws and regulations apply. As stated above, the Contest is void where prohibited or restricted by law. By participating in these Sweepstakes, you acknowledge that you have read these Contest Official Rules and agree to abide by them and by the decisions of MultiTracks.com, which are final and binding on all matters pertaining to the Sweepstakes. 

15. Governing Law: This Contest and the rights and obligations of the Sponsor and participants will be governed by and controlled by the laws of the State of Texas, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings, or litigation relating hereto will be instituted and prosecuted solely within the State of Texas, County of Travis. By participating in the Sweepstakes, you consent to the jurisdiction of the state courts of Texas and federal court located with such state and county with respect to any action, dispute, or other matter pertaining to or arising out of this Sweepstakes.

17. Winners List: To obtain a copy of the Winner’s name or a copy of these Official Rules, mail your request along with a stamped, self-addressed envelope to: MultiTracks.com, LLC, 1500 Arrow Point Dr., Suite 701, Cedar Park, Texas 78613 (USA). Requests must be received no later than 11:59 pm CST, February 28, 2024.

This Contest is in no way sponsored, administered, endorsed or associated with Instagram, Inc.  By entering, entrants confirm they are at least 18 years of age, release Instagram of responsibility, and agree to Instagram’s terms of use and privacy policy.
